The city of Columbus prohibits truck drivers from driving trucks carrying hazardous materials within the city limits and requires drivers to only use Interstate 270. If a truck driver does not have a pickup or delivery within the city limits and drives inside of Interstate 270 without first obtaining a proper permit, then the driver may be charged with Traffic Control Device, a violation of Ohio Revised Code 2113.01(A) for violating the HAZMAT signs that are on the highway and Transport of Hazardous Materials, a violation of Ohio Revised Code 2551.06(A). Generally, a Traffic Control Device ticket is given with the criminal complaint of Transporting Hazardous Materials at the same time.
These violations have different implications for CDL drivers as the Traffic Control Device has two points and is a moving violation. It is a minor misdemeanor and carries a fine of $150.00, potential community service, and court costs. The Transport of Hazardous Materials (HAZMAT) is a Misdemeanor of the First degree but does not carry any points and is not a moving violation. However, the HAZMAT violation is a First degree misdemeanor which the maximum penalty is up to 180 days in jail, $1000 fine, court costs, and a community control sanction. If a driver has prior HAZMAT violations, then the punishment may be enhanced.
